No, you do not need a lawyer to apply for maintenance enforcement. The Maintenance Enforcement Division, under the Ministry of Law, has designed the process so you can handle it yourself.

When you don't need a lawyer

You can apply for maintenance enforcement on your own if:

  • Your case is straightforward (the other person simply stopped paying)

  • You have all the required documents ready

  • There are no disputes about the original maintenance order

  • You are comfortable filling out forms and following instructions

When you might want a lawyer

You may choose to hire a practising lawyer (a qualified legal professional) if:

  • Your case is complex (multiple orders, disputed amounts, or complicated financial situations)

  • The other party has a lawyer and you want equal representation

  • You are not comfortable handling legal documents yourself

  • There are disputes about the original maintenance order
