When am I required to lodge a traffic accident report?
A Traffic Accident Report must be lodged if the accident involves the following:
a. Fatality;
b. Damage to government property;
c. Foreign vehicle;
d. Pedestrian or cyclist;
e. Hit-and-run case; or
f. Injuries where
· at least one person involved in the accident was taken to hospital from the accident scene by an ambulance; or
· the injured party was conveyed to hospital using other means of transport but subsequently hospitalised or given outpatient medical leave for 3 days or more; or
· no party was conveyed from the scene to hospital, but at least one of the party involved subsequently required hospitalisation or obtained outpatient medical leave for 3 days or more.
A Police report is not required if the traffic accident did not involve any of the above criteria, did not result in any injury or where a person who suffered minor injuries as a result of the accident was subsequently treated as an outpatient and given less than 3 days of medical leave. In such instances, the parties involved should exchange particulars and report the matter to their respective insurance company, in accordance with the Motor Claims Framework (MCF).
