I am the vehicle owner, but I was not the driver responsible on the date of offence. Can TP charge me in Court?
You may still be charged in Court. Under Section 81 of the Road Traffic Act, you are presumed to be the driver who had committed the offence, unless you had furnished the particulars of the driver within 14 days from the date of the Notice issued to you.
As such, if you are not the driver of the offence, you are required to furnish the driver's particulars within 14 days from the date of the Notice. A Notice of Traffic Offence will be sent to the driver subsequently. Failure to furnish the driver's particulars constitutes an additional offence which carries a maximum penalty of $1000 or 6 months' imprisonment or both.
