What if I am unable to identify the driver who committed the said offence?

Under Section 81 of the Road Traffic Act, as the owner of the vehicle, you are presumed to be the driver who had committed the offence, unless you prove otherwise.

As such, if you are not the driver of the offence, you are required to furnish the driver's particulars within 14 days from the date of the Notice. A Notice of Traffic Offence will be sent to the driver subsequently. Failure to furnish the driver's particulars constitutes an additional offence which carries a maximum penalty of $1000 or 6 months' imprisonment or both.
